FSA Investigation and Remediation
All firms seek to manage their business so as to avoid being the subject of any form of regulatory investigation. Notwithstanding this, circumstances can conspire so that firms can find themselves under increased and focused regulatory scrutiny. This can be a serious drain on the firms time and carry high risks if the regulator is not quickly satisfied regarding its findings.
Even where there has been no transgression of the rules, requirements or expectations, it is essential that firms deal with any form of investigation so as to help satisfy the FSA as quickly and painlessly as possible.
IMS has an unrivalled number of ex-FSA staff from both the supervision and enforcement areas of the FSA. Therefore IMS is in a unique position to understand the motives and desires of the FSA when it investigates any particular issue.
A firm's interaction with the regulator will generally fall under one of the following categories:
- Assisting with Thematic visits and Responding to Email questionnaires
- Transaction Monitoring Enquiries (TME)
- Enforcement Investigations
IMS can help firms deal with regulator's questions to help the business satisfy itself, and the regulator, in order that the regulatory risk can be significantly managed and to allow the firm to continue with its business with the minimum of interruption.
